Terms and conditions

Introduction

These general terms and conditions of sale apply to web transactions managed through the website www.lemuseonline.com (hereinafter referred to as the "Site") and govern the offer and sale of goods promoted online by Le Muse S.r.l. (hereinafter referred to as the "Seller"), with registered office in Milan, 20154, Via Maroncelli 2, VAT number 08080350153, PEC: lemuseonline@pec.it.

These general terms and conditions of sale are drafted in accordance with the legal provisions of the Italian Civil Code and Legislative Decree No. 206 of September 6, 2005, as amended by Legislative Decree No. 21 of February 21, 2014 (Consumer Code).

In order to proceed with the purchase of one or more products offered on the pages of the Site, users are required to register and expressly accept these general terms and conditions of sale in order to have access to them even after the conclusion of the contract.

Acceptance of these terms and conditions is a fundamental requirement for the purchase of any product on the Site.

1.Scope of Application

These general terms and conditions apply to and govern all sales contracts concluded through the website www.lemuseonline.com, as identified above, hereinafter referred to as the "Seller".

The conditions may be amended at any time, so the User is therefore required to consult them before making any purchase.

2.Definitions

Where mentioned in the contract, the following terms have the following meanings:

Seller: Le Muse S.r.l., Via Maroncelli, 2, 20154 Milan, VAT number 08080350153;

Buyer/consumer: the consumer or user, an individual over the age of eighteen, who enters into this contract for the purpose of purchasing goods from the Seller.

3.Conclusion of the Contract

Product Consultation

By consulting the pages of the Site and clicking on the corresponding icons for the items, the user can easily "navigate" through the virtual catalog of goods marketed by Le Muse S.r.l.

Registration

To proceed with the purchase of goods, the user must register, or if already registered, enter their username and password. 

To make the purchase, the user will be required to accept the terms and conditions of sale, which will remain accessible on the pages of the Site. At the time of registration, the user must enter their personal data necessary for the purchase, delivery of the goods, and invoicing.

Delivery and Invoicing Methods

Once registration is complete, or in the case of an already registered user, after entering their username and password, the user will be prompted to provide all the data regarding the invoice holder and the delivery address for the goods they intend to purchase.

4.Payment Methods

Payment must be made within 7 (seven) working days from the date of the order, otherwise the order will be canceled.

The accepted payment method is bank transfer, IBAN IT03C0306909423100000001530, payable to Le Muse S.r.l.

To expedite the shipment of the goods, please send the payment receipt via email to info@lemuseonline.com, indicating the order number.

Payment can also be made through PayPal (with a 5% surcharge) or by credit card through the PayPal payment system.

5.Shipping Information

Shipments will be made through an affiliated courier covered by an insurance policy.

The cost of shipping varies depending on the destination country. The cost will be determined when the user provides all the necessary personal data, including the shipping address, for the purchase of the goods and related invoicing.

To ensure efficient delivery service, it is necessary to provide the user's telephone number to the courier.

At the discretion of the Seller, insured shipping may be offered.

6.Delivery of Goods

The products are delivered directly to the User at the shipping address specified during the ordering process, through affiliated couriers.

7.Right of Withdrawal

The Buyer, as a consumer, has the right to withdraw from the sales contract without penalty and without specifying the reason, as provided for in Article 52 of Legislative Decree No. 206/2005 (Consumer Code), within a period of 14 (fourteen) calendar days, starting from the day on which the buyer, or a third party other than the carrier and designated by the Buyer, acquires physical possession of the goods. To comply with the withdrawal period, it is sufficient for the consumer to communicate the decision to withdraw before the expiration of the withdrawal period.

The right of withdrawal is excluded for the supply of goods made to measure or clearly personalized, pursuant to Article 59, letter c) of the Consumer Code. This category also includes goods for which the consumer requests measurements different from those indicated by Le Muse S.r.l. in the product presentation pages.

8.Effects of Withdrawal

The consumer who exercises the right of withdrawal is entitled to receive a refund of all payments made, including any shipping costs, without undue delay and in any case no later than 14 (fourteen) days from the day on which Le Muse S.r.l. is informed of the consumer's decision to withdraw from the contract. The refund will be made by bank transfer to the bank account indicated by the consumer on the withdrawal form.

The consumer must return the goods to Le Muse S.r.l. without undue delay and in any case no later than 14 (fourteen) days from the date on which they communicated their decision to withdraw from the contract. The deadline is met if the goods are returned before the expiration of the 14-day period. The direct costs of returning the goods are borne by the consumer. All goods must be returned in their original packaging, complete with all accessories, the tag with the code, the relevant user manuals, and any other items received.

9.Warranty

Le Muse S.r.l. is responsible to the consumer, in accordance with Articles 128 et seq. of the Consumer Code, for any lack of conformity existing at the time of delivery of the goods.

In the event of a lack of conformity, the consumer is entitled to restoration, free of charge, of the conformity of the goods through repair or replacement, or to an appropriate price reduction or termination of the contract, under the conditions provided for in Article 130 of the Consumer Code.

In order to enforce the warranty, the consumer must notify the Seller of the lack of conformity of the goods within 2 (two) months from the date on which they discovered the defect. The warranty covers non-conformities that occur within 1 (one) year from the delivery of the goods.

The notification of the lack of conformity must be sent by registered letter with return receipt to the registered office of Le Muse S.r.l. or by certified email (PEC).

The user must prepare the goods for collection by the representatives of Le Muse S.r.l., who will pick them up at the address provided by the consumer within a indicative period of 7 (seven) working days.

To facilitate the process, the consumer must carefully package the goods. After receiving the goods and inspecting them, Le Muse S.r.l. will restore their conformity within a reasonable period, as provided for in Article 130 of the Consumer Code.

11.Processing of Personal Data

We inform you that the personal data processed are those provided to Le Muse S.r.l. by the Buyer for the execution of the contractual relationship. The provision of all data related to this contract is strictly related to the execution of the relationship. Failure to provide such data will make it impossible to carry out the contractual relationship.

The data controller, pursuant to EU Regulation 2016/679, is Le Muse S.r.l., Via Maroncelli, 2 - 20154 Milan, email: info@lemuseonline.com; the Buyer may contact them at any time to exercise their rights as a data subject, as provided for in Articles 15-22 of EU Regulation 2016/679.

12.Applicable Law and Jurisdiction 

Any dispute between the Seller and the Buyer regarding the Contract and its performance shall be governed by Italian law and shall be administered, except for any derogations, by the judges of the consumer's jurisdiction. The Buyer will in any case be guaranteed the rights conferred by the mandatory consumer protection laws in force in their country of residence and/or domicile.
